General FAQs
What is a Receiver?
“The Receiver is the individual who assumes responsibility for all assets of the entities in receivership in the civil enforcement action brought by the SEC. He is responsible for taking control of Defendant (BKCoin Management, LLC) and Relief Defendants (BKCoin Capital, LP, BK Offshore Fund, Ltd., BKCoin Multi-Strategy Master Fund, Ltd., BKCoin Multi-Strategy Fund, LP, BKCoin Multi-Strategy Fund Ltd., and Bison Digital LLC) (collectively, the “Receivership Entities”) and their assets, and administering those assets as instructed by the Court. Ultimately, the Receiver will determine the amounts owed to defrauded investors and creditors and the Receiver will distribute available assets in accordance with a plan approved by the Court.
A Receiver is an officer of the Court and ultimately answers to the Court. In this case, Michael I. Goldberg, Esq., is the Court-appointed Receiver for the Receivership Entities.”

How can I stay informed of the progress in this case?
The Receiver will post new information on this website from time to time, including Key Court Documents, Receiver’s Letters & Status Reports, General FAQs, and Claims Process FAQs.
If I have other questions, how can I get them answered?
This website will be the Receiver’s main method of communicating with various investors and creditors of the Receivership Entities, other interested persons, and the general public. We strongly encourage interested persons to check the website frequently, as the Receiver will be updating it as he obtains new information.
Please direct all inquiries to the Receiver by sending an e-mail directly to the Receiver at BKCoin@akerman.com. The Receiver’s professional team will review your inquiries and, if appropriate, the Receiver or a member of the Receiver’s team will respond to your inquiry. In circumstances when multiple persons submit similar questions, the Receiver anticipates that he will address those questions by updating the FAQ section of this website.
Although we recommend sending an e-mail with any questions or inquiries you may have, you may also contact the Receiver by telephone at: (800) 223-2234.
When will money be distributed to investors?
It is impossible at this stage to provide an estimate for when funds will specifically be distributed to Claimants. However, funds will not be distributed to Claimants until after the Court approves a distribution plan.
Is the Receiver my lawyer?
No. The Receiver is not your lawyer, and he cannot provide you with legal advice. He is the Court’s agent, and he is effectuating the provisions of the Court’s orders.
Should I hire a lawyer?
You certainly have the right to hire or consult with your own lawyer. The Receiver is investigating all potential claims that could provide recovery to the Receivership Estate in order to maximize the pool of assets that will be available for distribution to all creditors. Regardless of whether or not you have a lawyer, the Court will authorize a distribution plan that treats all similarly situated creditors the same.
How long does the receivership process take?
At this stage of the proceedings, we cannot predict how long it will take to complete this process.
What authority does the Receiver have?
The Court’s Order governs the authority of the Receiver. Federal courts have specific powers, known as “equitable” powers, to order relief to advance the purposes of the federal securities laws, preserve investor funds, and ensure that wrongdoers do not profit from their unlawful conduct. Courts may grant broad powers to receivers, including the authority to sue on behalf of the Receivership Entities and to gather, manage and liquidate receivership assets on behalf of potential creditors and harmed investors.
Should I send copies of my papers proving that I am an investor to the Receiver?
Please see the Claims Process and Claims Process FAQ sections.
